Terms of Service

Hello and thank you for the interest in my work!By purchasing art and or characters/designs from me, you are agreeing to these termsBy commissioning me, you are agreeing that you are at least 18 years old.These terms may be changed/altered at any time so please be sure to read through them before contacting me.

★ In regards to Payment/Refunds:

I only accept payment via Paypal or Kofi, I generally prefer to use invoices but for smaller amounts I will accept payment through Kofi.Full payment is due upfront for commissions less than $50 usd before I start them.I will accept partial payment on larger commissions, as long as full payment is received within a week.
If partial payment is required, please discuss this with me beforehand.If full payment is not received, your commissions will be dropped. If you sent partial payment, it will be refunded.I will send an invoice or direct link for payment. Any payment received outside of the invoice or direct link will be considered a donation, gift, or tip.I reserve the right to cancel your commission at any time. If I decide to cancel your commission(s), you will receive a full refund, regardless of the progress I've made.If you decide to cancel your commission(s), you will only receive a full refund if I have yet to start your commission. Otherwise, your refund will be determined on the amount of work completed at cancellation.No refunds will be given after the commission is complete.

★ Edits and Changes:

For all commission types aside from sketches I will provide you with visual updates throughout the process of your commission. If you would prefer not to receive updates please let me know beforehand.You may ask for edits during the sketch, lineart and flat color phases of your commission without additional charge.You may not ask for edits once I have completed the commission.You may not edit or trace the commission yourself, or contact another artist to do so.You may color lineart or paint over a sketch, as long as there is proper credit to me for the initial sketch, as well as a clear distinction between the content provided and my own content**You may NOT color lineart or paint over a sketch using AI programs currently in existence or created in the future.You may crop or edit for layout purposes; icons, banners, etc. as long as the original content of the artwork is not edited.

★ Regarding you, the client:

You may repost your commission as long as proper credit or a direct link back to me or the original post is given.You may not commission me to draw a character you do not own without the original owner's consent.You may not create copies, prints, or other merchandise with the intent to sell or for profit. Any and all merchandise created by the client should be for personal use only.Please let me know beforehand if your commission should remain private. I will respect and retain your privacy.My artwork may not under any circumstances be tokenized, used for NFTS or otherwise minted for any type of crypto currencies currently in existence or created in the futureMy artwork may not under any circumstances be used or uploaded to AI programs currently in existence or created in the future.

★ Regarding me, the artist:

I own all copyrights of the commission. I also reserve the right to copy, reproduce, and reuse the image for self-promotion and advertisements. I will not reproduce your commission with the intent to sell or for profit.Unless a due date is previously agreed upon I reserve the right to take as long as I like on a commission.
I refuse to work with any reference sheet or images given to me by clients created using any and all AI programs currently in existence or created in the future.Once completed I will only be keeping the completed commission file for a maximum of three months. It is up to you, the client, to download and save the image to where you may access it.I reserve the right to refuse a commission under any circumstances.

Character/Adopts/Design Terms of Service

★ In regards to payment/refunds:

Monetary payments will only be accepted through Paypal.Monetary payments are due upfront after claiming a design. I will not hold designs for anyone. You have 24 hours after claiming to get back to me or I will place the character back up for sale.Full payment must be sent before high res, unwatermarked files are sent/character ownership is transferred on Toyhou.se Website.Art payments must be completed before I transfer the character.Art payments must be completed within One (1) month of accepted offer unless otherwise stated. Extensions will be granted depending on the circumstances.Please wait for my approval before sending character transfers for character trades/swaps.I reserve the full right to cancel a trade if I feel I am being deceived. EX refusing to send payment for an extended period of time, constantly coming up with excuses for not providing art payments, etc. If I ever feel uncomfortable I will cancel a trade and black list you from trading with me in the future.All trades and sales are final.

★ Regarding you, the client:

You may not claim you designed/created the character. Even if you redesign them down the line.You may alter the design as long as it still resembles the original design.You may not create siblings or copies of the design you've purchased. (this includes making a sibling/twin design as that can easily lead to confusion if they are ever separated)You may create alternate forms of the design for closed species ONLY if you alert me beforehand and follow the rules of the closed species you wish to enter the design into.You may not resell the design for more than what you paid for UNLESS there is monetary increase via commissioned artwork of said character.You may not add on the worth of traded designs to inflate the worth of the design obtained in regards to characters I have designed. EX: trading a $10 usd design for a $15 usd design does not increase the original $10 design's worth to $25 usdYou may trade or gift the character to whomever you please. Gifting or trading does no devalue the design and they can still be resold for their original sale price.You may create copies, prints, or other merchandise with the intent to sell or for profit of the design as long as it is not my artwork of the design.

★ Regarding me, the artist:

I relinquish copyright of the design once sold/traded.You are free to use the character for personal or commercial use once purchased.I retain copyright over the artwork I have created of the design. I also reserve the right to copy, reproduce, and reuse the image for self-promotion and sale advertisements. I will not reproduce your design with the intent to sell or for profit.Once sold/traded I will only be keeping character/design files for a maximum of three months. It is up to you, the client, to download and save the image(s) to where you may access them.I reserve the right to refuse to sell or trade a design under any circumstances.
